Deschid un mic serial relativ la instrumente legale na\u021bionale sau interna\u021bionale cu privire la drepturile fundamentale ale omului \u0219i la libert\u0103\u021bile cet\u0103\u021bene\u0219ti, instrumente care au picat \u00eentr-o nemeritat\u0103 \u0219i periculoas\u0103 uitare.<\/h2>\n<\/div>\n

(I)<\/strong><\/div>\n<\/div>\n
\n
Un prim astfel de instrument, o lege uitat\u0103, dar fundamental\u0103, a \u00eentregii umanit\u0103\u021bi, este Pactul interna\u021bional cu privire la drepturile civile \u0219i politice, adoptat \u00een cadrul ONU \u00een anul 1966. A se observa c\u0103 adoptarea acestui instrument esen\u021bial al drepturilor omului s-a petrecut \u00een plin r\u0103zboi rece, la c\u00e2\u021biva ani de la criza cubanez\u0103 a rachetelor nucleare, care ar fi putut declan\u0219a un distrug\u0103tor al treilea r\u0103zboi mondial. \u00cen nebunia actual\u0103, poate lumea se d\u0103 un pas \u00een spate, pentru a lua aminte \u0219i a \u00eenv\u0103\u021ba ceva din circumstan\u021bele acestui Pact.<\/div>\n<\/div>\n

\u00cen prealabil, voi reaminti c\u0103, potrivit art.11 alin.1-2 din Constitu\u021bie, Statul rom\u00e2n se oblig\u0103 s\u0103 \u00eendeplineasc\u0103 \u00eentocmai \u0219i cu bun\u0103-credin\u021b\u0103 obliga\u021biile ce-i revin din tratatele la care este parte, tratate care fac parte din dreptul intern. Din aceast\u0103 categorie face parte \u0219i Pactul mai sus enun\u021bat, pact ratificat de Rom\u00e2nia prin Decretul nr.212\/1974. Potrivit art. 20 din Constitu\u021bie, dispozi\u021biile constitu\u021bionale relative la drepturile \u0219i libert\u0103\u021bile cet\u0103\u021benilor trebuie interpretate \u0219i aplicate \u00een concordan\u021b\u0103 cu Declara\u021bia Universal\u0103 a Drepturilor Omului (1948) \u0219i cu pactele \u0219i tratatele referitoare la drepturile fundamentale ale omului la care Rom\u00e2nia este parte. Legile interne, contrare acestor pacte \u0219i tratate, sunt \u00eenl\u0103turate de la aplicare. Multe dispozi\u021bii din Legea contenciosului administrativ nr.544\/2004 sunt contrare acestui Pact \u2013 enun\u021b aici doar acel text normativ care nu permite suspendarea unui act administrativ privitor la epidemii (pe baza acestuia s-au respins toate cererile se suspendare, chiar dac\u0103 ulterior au fost anulate toate hot\u0103r\u00e2rile de guvern referitoare la starea de alert\u0103, cu consecin\u021ba cre\u0103rii uneia dintre cele mai bizare anomalii juridice din istorie \u2013 justi\u021bia tot anuleaz\u0103 astfel de hot\u0103r\u00e2ri, iar guvernul tot emite altele \u0219i altele, pe motiv c\u0103 deciziile justi\u021biei nu sunt executorii…). De asemenea, sunt total contrare acestui Pact at\u00e2t Legea privind starea de alert\u0103 nr.55\/2020, c\u00e2t \u0219i Legea carantin\u0103rii nr. 136\/2020, legi pe care Arafat le-a cerut, iar Parlamentul i le-a pus, docil, la picioare, pentru ca Arafat \u2013 bei, gomandant de la ag\u021biune, s\u0103 fac\u0103 tot ceea ce vrea \u00een plandemie.<\/div>\n<\/div>\n

Din analiza acestui Pact rezult\u0103 c\u0103 singurele drepturi colective reglementate sunt dreptul popoarelor la auto-determinare \u0219i dreptul de a dispune liber de bog\u0103\u021biile \u0219i resursele lor naturale (a se vedea art. 1 din pact).<\/div>\n<\/div>\n
\n
Nu exist\u0103 nic\u0103ieri \u00een acest Pact un drept colectiv la s\u0103n\u0103tate public\u0103, ci drepturi individuale la via\u021b\u0103 \u0219i s\u0103n\u0103tate.<\/div>\n<\/div>\n
\n
\u00cen ciuda insisten\u021bei statelor comuniste, \u00een frunte cu URSS, care au presat pentru introducerea \u00een Pact a c\u00e2t mai multor drepturi colective ale omului \u0219i pentru prioritizarea drepturilor colective asupra drepturilor individuale, decizia care s-a impus a fost cea a statelor \u201eoccidentale\u201d, care au insistat pentru drepturi individuale \u0219i pentru prevalen\u021ba acestora asupra drepturilor colective.<\/div>\n
Din aceast\u0103 perspectiv\u0103 este mai mult dec\u00e2t bizar\u0103, este odioas\u0103 inten\u021bia Uniunii Europene de a for\u021ba statele membre s\u0103 \u00ee\u021bi modifice constitu\u021biile \u00een asemenea manier\u0103 \u00eenc\u00e2t s\u0103 includ\u0103 o ordine de preferin\u021ba a drepturilor fundamentale, \u00een care drepturile colective s\u0103 primeze drepturilor individuale \u0219i, \u00een plus, s\u0103 se asigure primordialitatea absolut\u0103 a deciziilor birocratice ale Uniunii Sovietice Europene de la Bruxelles \u0219i Strasbourg.<\/div>\n<\/div>\n

Iat\u0103, mai jos, c\u00e2teva exemple din texte esen\u021biale din acest Pact, care sunt totalmente ignorate de actuala elit\u0103 tehnocratic\u0103 \u0219i de iacobinismul sanitar euro-atlantic:<\/div>\n<\/div>\n
\n
-potrivit art. 2 pct. 3 lit.a) din Pact, Statele parti la prezentul pact se angajeaz\u0103 s\u0103 garanteze c\u0103 orice persoan\u0103 ale c\u0103rei drepturi sau libert\u0103\u021bi recunoscute \u00een prezentul pact au fost violate va dispune de o cale de recurs efectiv\u0103, chiar atunci c\u00e2nd \u00eenc\u0103lcarea a fost comisa de persoane ac\u021bion\u00e2nd \u00een exerci\u021biul func\u021biilor lor oficiale;<\/div>\n
-potrivit art. 26, toate persoanele sunt egale \u00een fata legii si au, f\u0103r\u0103 discriminare, dreptul la o ocrotire egal\u0103 din partea legii; \u00een aceasta privin\u021b\u0103, legea trebuie s\u0103 interzic\u0103 orice discriminare \u0219i s\u0103 garanteze tuturor persoanelor o ocrotire egala si eficace contra oric\u0103rei discrimin\u0103ri, \u00een special de rasa, culoare, sex, limba, religie, opinie politica sau orice alta opinie, origine na\u021bionala sau sociala, avere, na\u0219tere sau \u00eentemeiata pe orice alta \u00eemprejurare*;<\/div>\n
-potrivit art. 7, sunt interzise tortura, tratamentele degradante sau inumane \u0219i, \u00een special, experimentele medicale sau \u0219tiin\u021bifice for\u021bate\/neconsim\u021bite;<\/div>\n
-potrivit art. 8, sunt interzise sclavia \u0219i supu\u0219enia for\u021bate;<\/div>\n
-potrivit art. 18 sunt interzise imixtiunile \u00een via\u021ba intima, personal\u0103 sau familial\u0103.<\/div>\n<\/div>\n

Referitor la situa\u021bii de urgen\u021b\u0103 sau de calamitate, art. 4 din Pact dispune dup\u0103 cum urmeaz\u0103;<\/div>\n
\u201d1. \u00cen cazul \u00een care un pericol public excep\u021bional amenin\u021b\u0103 existen\u021ba na\u021biunii si este proclamat printr-un act oficial, statele p\u0103r\u021bi la prezentul pact pot, \u00een limita strict\u0103 a cerin\u021belor situa\u021biei, s\u0103 ia m\u0103suri derogatorii de la obliga\u021biile prev\u0103zute \u00een prezentul pact, cu condi\u021bia ca aceste masuri s\u0103 nu fie incompatibile cu celelalte obliga\u021bii pe care le au potrivit dreptului interna\u021bional \u0219i ca din ele s\u0103 nu rezulte o discriminare \u00eentemeiata numai pe ras\u0103, culoare, sex, limba, religie sau origine social\u0103\u201d.<\/div>\n<\/div>\n

[a se observa c\u0103 textul insist\u0103 asupra caracterului excep\u021bional \u0219i asupra gravit\u0103\u021bii \u2013 trebuie s\u0103 fie vorba de o amenin\u021bare la existen\u021ba na\u021biunii \u2013 precum \u0219i asupra limitelor stricte ale derog\u0103rilor; de asemenea, a se observa c\u0103 se insist\u0103 asupra caracterului public, deschis, onest, al proclama\u021biei st\u0103rii de urgen\u021b\u0103\/calamitate, ceea ce \u00een Rom\u00e2nia plandemic\u0103 nu s-a respectat niciodat\u0103 – nici m\u0103car acum nu avem un act oficial de declarare a epidemiei; foarte interesant\u0103 din perspectiva suveranismului rational, opus globalismului regresist, este referin\u021ba la \u201ena\u021biune\u201d \u0219i la existen\u021ba ei, care justific\u0103 m\u0103suri grave de prezervare din partea statului\u2026]<\/div>\n<\/div>\n
\n
\u201d2. Dispozi\u021bia precedent\u0103 nu autorizeaz\u0103 nici o derogare de la prevederile art. 6, 7, 8 (paragrafele 1 si 2), 11, 15, 16 si 18\u201d.<\/div>\n<\/div>\n

[este vorba de dreptul la via\u021b\u0103, de interzicerea torturii, a tratamentelor degradante \u0219i inumane \u0219i interzicerea experimentelor medicale sau \u0219tiin\u021bifice, de interzicerea sclaviei \u0219i a servitu\u021bii\/supu\u0219eniei for\u021bate, de interzicerea imixtiunilor \u00een via\u021b\u0103 intim\u0103, familial\u0103 sau particular\u0103, \u0219i de libertatea religioas\u0103 \u0219i de opinie\/convingere \u2013 nu exist\u0103 derog\u0103ri permise de la aceste drepturi \u0219i libert\u0103\u021bi nici m\u0103car \u00een situa\u021bii de urgen\u021b\u0103]<\/div>\n<\/div>\n

\u201d3. Statele p\u0103r\u021bi la prezentul pact care fac uz de dreptul de derogare trebuie ca prin intermediul secretarului general al Organiza\u021biei Na\u021biunilor Unite s\u0103 semnaleze de \u00eendat\u0103 celorlalte state p\u0103r\u021bi dispozi\u021biile de la care au derogat, precum si motivele care au provocat aceasta derogare. O noua comunicare va fi f\u0103cut\u0103, prin acela\u0219i intermediu, la data la care ele au pus cap\u0103t derog\u0103rilor\u201d.<\/div>\n<\/div>\n

[evident c\u0103 nimeni, niciodat\u0103, nu \u0219i-a pus problema unei astfel de notific\u0103ri, ceea ce \u00eenseamn\u0103 c\u0103 totul, absolut totul, \u00een plandemia rom\u00e2neasc\u0103, a fost complet nelegal \u0219i anti-constitu\u021bional, de vreme ce nu s-a respectat acest text din Pact]<\/div>\n<\/div>\n

Covrigul de doi lei<\/div>\n<\/div>\n
\n
Am asistat ieri la o discu\u021bie \u201eusoar\u0103\u201d, \u00een chicineta de la birou, dup\u0103 pr\u00e2nz. Un coleg spunea, \u0219ocat, c\u0103 a cump\u0103rat un covrig cu 2 lei. Cu o lun\u0103 \u00een urm\u0103, covrigul era 50 de bani. E de la cre\u0219terea exploziv\u0103 a pre\u021bului utilit\u0103\u021bilor \u0219i de la sc\u0103derea abrupt\u0103 a puterii de cump\u0103rare. Dar covrigul de 50 de bani era un indicator al puterii de supravie\u021buire \u2013 ce se va \u00eent\u00e2mpla acum cu acei oameni care nu \u00ee\u0219i permit alte \u201etrata\u021bii\u201d dec\u00e2t covrigul, dup\u0103 cvadruplarea pre\u021bului?<\/div>\n
La tv, dup\u0103 ce guvernul a anun\u021bat c\u0103 prelunge\u0219te \u00eenc\u0103 o dat\u0103 starea de alert\u0103, ignor\u00e2nd total \u0219i dispre\u021buind arogant deciziile justi\u021biei (care a anulat toate hot\u0103r\u00e2rile anterioare de guvern referitoare la starea de alert\u0103), jurnali\u0219tii au \u00eenceput s\u0103 bombardeze popula\u021bia cu \u201einforma\u021bii\u201d despre noile m\u0103\u0219ti obligatorii \u0219i despre testele inevitabile pl\u0103tibile din buzunarul simplului cet\u0103\u021bean, care inten\u021bioneaz\u0103 s\u0103 munceasc\u0103, s\u0103 studieze sau pur \u0219i simplu s\u0103 \u00ee\u0219i tr\u0103iasc\u0103 via\u021ba. Culmea inadecv\u0103rii guvernametale este c\u0103 au devenit obligatorii ni\u0219te m\u0103\u0219ti despre care autorit\u0103\u021bile competente (ticsite, desigur, de exper\u021bi) spun c\u0103 sunt \u00een propor\u021bie de peste 60% neconforme, iar testul RT – PCR este considerat nefezabil de c\u0103tre CDC din SUA, pe motiv c\u0103 nu poate face distinc\u021bia \u00eentre grip\u0103 \u0219i cou_veed. Plus c\u0103, \u00een Rom\u00e2nia, noile m\u0103\u0219ti si testele de acest gen sunt neobi\u0219nuit de scumpe. Dupa calcule simple \u0219i reduc\u021bioniste, m\u0103\u0219tile \u0219i testele ar urma s\u0103 coste, individual, cel pu\u021bin 1500 lei lunar \u2013 un salariat normal, care mai are \u0219i utilit\u0103\u021bi \u0219i rate de pl\u0103tit dintr-un salariu de 3000 de lei lunar nu va putea face fa\u021b\u0103 acestui nou cost. Practic, printr-o pervers\u0103 scriere a reglement\u0103rilor, omul simplu care nu vrea s\u0103 se lase violat sanitar \u00een cadrul unui experiment medical nebunesc, va ajunge s\u0103 cedeze la un moment dat, din motive economice, iar nu medicale.<\/div>\n
Ironic, \u00een timp ce autorit\u0103\u021bile fascistoide franceze extind la toat\u0103 lumea obligativitatea \u201epa\u0219aportului\u201d vakseenal, personalul sanitar recent concediat pentru refuzul vioulul sanitar este re-chemat la serviciu, din motive de iminent colaps al sistemului sanitar. Mai mult chiar, personalul sanitar u\u0219or bolnav sau pentru care nu a trecut \u00eenc\u0103 perioada de izolare\/carantin\u0103, este de asemenea re-chemat la serviciu, din acela\u0219i motiv.<\/div>\n
Evident, autorit\u0103\u021bile noastre guvernamentale nu au perceput \u00eenc\u0103 acest risc, dar la noi va fi fost mult mai grav dac\u0103 se va impune vakseenarea personalului care lucreaz\u0103 \u00een acest domeniu, precum \u0219i \u00een educa\u021bie \u0219i \u00een infrastructura critic\u0103 na\u021bional\u0103. De ce? Pentru c\u0103 procentul de refuz al violului sanitar este mult mai mare la noi.<\/div>\n
\u00cen alt\u0103 ordine de idei, prin reglement\u0103ri infralegale sau prin regulamente de ordine interioar\u0103, mul\u021bi oameni au fost trimi\u0219i \u00een concediu, pe motiv de refuz al violului sanitar. Nu doar c\u0103 se \u00eencalc\u0103 legisla\u021bia muncii \u00een aceste cazuri (fapt echivalent cu abuzul \u00een serviciu penal), dar dreptul la via\u021b\u0103 al celor concedia\u021bi pentru asemenea oroare de motiv este aneantizat. F\u0103r\u0103 un venit, f\u0103r\u0103 o plas\u0103 de siguran\u021b\u0103 social\u0103, asemenea oameni sunt condamna\u021bi, al\u0103turi de familia lor, la pieire. F\u0103r\u0103 motiv, f\u0103r\u0103 sentin\u021b\u0103, f\u0103r\u0103 mil\u0103, f\u0103r\u0103 fric\u0103 de Dumnezeu.<\/div>\n<\/div>\n

Ace\u0219ti oameni nu vor mai avea nici m\u0103car bani de covrigul de 2 lei.<\/div>\n<\/div>\n

Or, Pactul international cu privire la drepturile civile \u0219i politice protejeaz\u0103 dreptul la via\u021b\u0103 (art. 6 pct.1), care include dreptul la mijloace de subzisten\u021b\u0103 prin munc\u0103 onest\u0103 \u0219i corect pl\u0103tit\u0103 \u0219i prin liber\u0103 ini\u021biativ\u0103, dreptul la plasa de siguran\u021b\u0103 social\u0103, precum \u0219i dreptul la modul (stilul) propriu de via\u021b\u0103.<\/div>\n<\/div>\n
\n
Pentru ce sunt abandonate aceste drepturi? Pentru o politic\u0103 de s\u0103n\u0103tate public\u0103 \u00een plandemie care s-a dovedit a fi orice altceva (inclusiv o continua partid\u0103 prosteasc\u0103 de wrestling mexican), cu excep\u021bia unei coerente ac\u021biuni de combatere a crizei sanitare \u0219i pentru (in)succesul unui experiment medical care s-a dovedit a fi nu numai initul, ci \u0219i nociv, mult mai nociv dec\u00e2t molima \u00eens\u0103\u0219i, pe care ar fi trebuit s\u0103 o stopeze sau s\u0103 o previn\u0103.<\/div>\n
Chiar \u00eenc\u0103lze\u0219te pe cineva cu ceva acest dezastru \u00een domeniul drepturilor individuale ale omului, de exemplu, pe cei care cred c\u0103 vakseenul \u0219i codul QR le ocrote\u0219te lor dreptul la via\u021b\u0103 \u0219i \u201elibertatea\u201d de supu\u0219i docili ai unui regim totalitar \u0219i ai unui iacobinism reinventat sub denumirea de \u201epolitici sanitare\u201d?<\/div>\n
Nu cumva acest abandon al drepturilor fundamentale este, de fapt, un camuflaj pentru afaceri veroase, furt, corup\u021bie, conflicte de interese \u0219i men\u021binerea la putere cu orice pre\u021b a actualei prostocra\u021bii?<\/div>\n
Sau, \u0219i mai grav, \u0219i mai sinistru: nu cumva asist\u0103m la un plan de reducere selectiv\u0103 a popula\u021biei prin metode medicale \u0219i apartheid sanitar?<\/div>\n<\/div>\n

Este cineva \u00een structurile guvernamentale, \u00een Parlament, \u00een societatea civil\u0103 sau \u00een pres\u0103 care s\u0103 se g\u00e2ndeasc\u0103 la aceste lucruri?<\/div>\n<\/div>\n
